Learning Outcomes and Application This unit of competency describes the skills and knowledge required to ensure the principles of administrative law are applied in the investigation and resolution of racing matters.The unit applies to individuals authorised to conduct and resolve racing incident investigations in greyhound, harness or thoroughbred codes.Greyhound, harness and thoroughbred racing are strictly regulated throughout Australia. All stewards are appointed under the rules of racing by the relevant Principal Racing Authority (PRA). Users are advised to check with the relevant PRA for requirements.No occupational licensing, legislative or certification requirements apply to this unit at the time of publication.
Duration and Setting X weeks, nominally xx hours, delivered in a classroom/online/blended learning setting.

Elements of Competency Performance Criteria              
Element: Apply the principles of administrative law
  • Apply natural justice to the investigation and resolution of racing matters
  • Follow racing protocols and procedures and due processes during the investigation and resolution of racing matters
  • Identify circumstances requiring the exercise of powers that are outside organisational or own limits, and refer to designated personnel
  • Identify potential risks associated with the exercise of powers and strategies to manage risks
  • Prepare documentation of investigations and interviews, complying with the rules of racing and principles of administrative law
       
Element: Conduct inquiries using effective interview techniques
  • Outline the purpose and intent of the interview to all participants, explaining rules and protocols to be followed
  • Organise and use communication and recording aids during interviews according to organisational requirements
  • Explain participant rights and responsibilities and determine the participant’s need for assistance
  • Use active listening and effective questioning techniques to elicit and clarify information
  • Apply strategies for dealing with difficult people and conflict situations
  • Conduct interviews and inquiries in a timely manner according to organisational protocols and principles of administrative law
       
Element: Make decision and determine appropriate penalties
  • Identify specific rules of racing that apply to the racing matter
  • Consult rules of racing to clarify information relating to the matter
  • Base decisions on evidence provided and according to the rules of racing
  • Consider penalties appropriate to the matter based on the evidence gathered, previous history of the participant and previous penalties for similar breaches of specific rules
  • Announce the decision and associated penalty, providing reasons to ensure a fair and transparent process
  • Explain right to appeal and associated process to the participant

Assessment Tasks
